			<description><![CDATA[The City council voted unanimously to approve the signing of a letter of intent on office space for the City of Menifee.  The building at 29714 - A Haun Rd, across from the Postal Annex.  The site is still under construction, but will be available the beginning of December.  The city will not be able to sign a lease agreement until October 1, when Menifee officially becomes a city.<br />

They will be able to setup offices at 29683 Suite C New Hub Drive after Oct 1, 2008, also owned by the same landlord as the Haun Rd property.<br />

This is Haun, north of Newport, that turns into New Hub.]]></description>

This is my response to the post by Tom Thurman on Menifee24/7 a bout how SCCA became 55+:<br />

My statements are quite true.  If you can prove other wise, I will then an only then take back my words and apologize.<br />

“She is accusing a deceased former SCCA board member of chicanery involved in the recording of the Sun City Civic Association's First Amended & Consolidated Declaration of Restrictions. She even accused her of doing something illegal.<br />
<br />
If Ms. Daniels would do a little research she would see that Mrs. Roberge did not sign any recorded documents in 1997.”<br />
<br />
May Jean Roberge rest in peace.  It still doesn’t alter the fact she headed up a project approved by the SCCA Board called “Project 55” for the purpose of obtaining 250 signatures on a petition to get the CC&R’s amended from age 18+ to 55+.  According to the SCCA bylaws of that time the petition was required to get the amendment put on a ballot so members could vote approval or not. (everything has been convoluted so many times by the board and its attorneys since then, who knows what they say now) Where is that ballot?  Where if there was a ballot is the voting results of the ballot?  How come you are not aware of “Project 55”?  Why was “project 55” ever begun if SCCA already had a 55+ only status?  <br />

What you do not know, Mr. Thurman, is that I saw a document filed with the county recorder signed by Jean Roberge with only her signature on it.  My only mistake was to fail to get a copy of that document when I had the chance.  If you research the minutes and other documents during the years of 1997 through 2001, you may find abundant information that will substantiate my claim.  However, I think you would prefer to make me bad and wrong than admit the mistakes of the SCCA Board.<br />
<br />
“The documents were in fact signed by Glen L. Roark President of the SCCA on 03/07/1997 and filed and recorded in Riverside County on 03/11/1997. As the separate tracts in the core approved the amendment requirements they were consolidated under the Consolidated Declaration. The process took a couple of years. The last annexation was dated and signed by Glenn L. Roark 2/1/1999 filed and recorded in Riverside County 2/22/1999. Most of the tracts required an approval vote of 2/3 of the total lot owners.”<br />

Now here is where this mess gets tricky.  The 1997 consolidation Mr. Thurman is referring was created by very clever attorneys for SCCA Board Members at the behest of the SCCA Board members.  The attorneys were paid with SCCA membership money.  Do you really think the membership was consulted about the content of this consolidation document?   Who approved it? The majority of the SCCA Board? Or did the 2/3 of the membership approve it-- which is what is required when CC&R’s are being amended?  The SCCA Board simply adopted the age 55+ restriction and included it in the consolidation and passed it off on the membership without a ballot and without membership full knowledge and understanding of consolidated declarations of 1997 tracts allegedly signed.  Again, I ask where is the ballot asking for an amendment for an age restriction that the membership was to vote upon? Show us that ballot? Show us the ballot that gave SCCA Board then authority to hire Epsten & Grinnel to rewrite the whole enchilada!<br />

“Jean Roberge, President and Betty Jo Adney Secretary of the SCCA signed an amendment to the First Amended & Consolidated Declaration on 08/23/2001.. . . It was filed and recorded on 9/17/2001 in Riverside County.”<br />

Once the Epsten and Grinnel brought SCCA Board legally along that far and this very questionable document recorded, it was all over for the membership to ever hope to fight a legal battle as to what and how they did this.<br />

“. . . The signing of this amendment was authorized by a majority vote of the Board of Directors of the SCCA at a meeting on 08/16/2001.”<br />

Check it out. Mr. Thurman admits the Board--  I repeat the -- SCCA Board signed this document.  At this stage he can argue that it is the Board’s duty to sign on behalf of the membership.  That I would agree.  However, at what point did the Board get permission from the membership to do so?  I was around then.  I don’t remember being asked. Show me where 2/3 of the membership voted approval for and signed an amendment to the age restriction!<br />
<br />
“ . . .This amendment was required to maintain compliance with the current requirements of State and Federal law applicable to housing for senior citizens.”<br />
<br />
It is interesting that SCCA Board failed to comply with its legal obligations after Jean Roberge obtained her 250 signed petition, to place this amendment on the ballot to obtain a 2/3 membership vote; but SCCA is so concerned about maintaining compliance regarding senior housing.  Could it be there is something wrong with this picture?<br />

“It is my opinion that Ms. Daniels has self-interest in her desire to open the core to all ages as she is a real estate person, and her primary concern is her pocket book and not the welfare of the homeowners in the core.”<br />
<br />
Isn’t this a standard response when people don’t know what else to say.  She is a real estate agent and has self interest and wants to make a lot of money.  I normally ignore such stupidity but I am going to answer it this time in hopes it enlightens people to reality. The majority of the years I practiced real estate was in Los Angeles where the big money is.  A realtor isn’t confined to one little tiny area like Sun City Core where the property values are among the lowest in California and the deals are the most difficult to close.  The real money properties are built all around and right to the borders of Sun City. They sell for more money, less aggravation, and no the added problem of age restrictions. Any realtor can make a great living without ever having to sell one 45+ year old property in the core when the market is just a little better than the one we are in.  So Mr. Thurman, take you head out of the sand and look around.  Sun City is obsolete.  I have no personal agenda to get rich on the poorest, most difficult property in the state of California.<br />
<br />
Yes, it is true.  You bet I would like to see the core opened to all ages. This would be in the highest and best interest of every property owner and member in the core. It will also bring fresh and new energy to this tired old core.  It will help us transform into the  new Menifee City and the 21 first century.  In case you haven’t noticed, times, life styles, attitudes, and needs have changed since 1964.  It is time SCCA awaken and change with them.  I will go one better.  I would like to see SCCA dissolved.  It is no longer needed and except for the 300 to 500 people who still use the facilities, no one cares about the activities.  SCCA is nothing but a money pit.  It offers no services of any value to me and over 4,000 of the rest of the members.  <br />

Home ownership is the great American dream.  It is their shelter and their investment. For most people it is the greatest investment of their life time. People are entitled to get the highest and best value from their properties.  This is not only good investment but it is moral, ethical, and right. SCCA is the perfect example why deed restricted titles are inferior to all other titles.  People cannot control their investments because the investments are in the control of Boards of Directors who think they know but don’t know the first thing about property value. The SCCA’s board minimized the value of the member’s real estate when it imposed the 55+ restriction. Isn’t it pitiful, Mr. Thurman, that people bought into Sun City Core hoping it would be a good investment for their old age only to lose it in foreclosure because of a minimum market created by age restriction?<br />
<br />
The sad reality is SCCA members have been harmed by the 55+ restrictions in many, many ways.  There are families whose older children who have fallen upon hard times these past few years who can not help their children by sharing their home because of the age restriction.  There are others who were counting on the sale of their property to take them into another life style who couldn’t sell their homes and lost them in foreclosure.  There are several abandoned homes because it is easier to just let them rot than to attempt to sell or rent because of the age restrictions.  The people in the core cannot refinance because values are so low. The families with gorgeous homes at the borders of the core cannot refinance either because the core neighborhood depreciates the value of their property. These are just a few reasons why age restricted communities are not in the highest and best interest of titleholders. The horror stories go on and on and on.  What about the welfare of these good, innocent and somewhat naïve families, Mr. Thurman?  Don’t you care about them?  I do.<br />

“We are allowed to discriminate based on age as a Senior Community in fact, it is encouraged by State and Federal laws.”<br />

That statement is a crock of manure. The state and federal laws neither encourage nor discourage age discrimination.  It is merely a permission given by state and federal for those seniors who choose to create a senior community. If you really understood anti discrimination laws, you would know age discrimination is forbidden unless a community has met the standards to be an age restricted community.<br />

“There are no laws that would allow us to lower the age limit to 18, 25, or 45. This would be illegal discrimination and we would be in violation of the Federal Fair Housing Act of 1988.”<br />

You are quite correct when you say there are no laws that would allow SCCA to return to the original adult only age 18+ status when Sun City was first developed.  The Unruh Act erased that.  However, there is nothing stopping Sun City from removing the 55+ restriction and start to restore property values so members could enjoy some equity.<br />

Menifee Valley Talk Radio plans to do several programs about the benefits and liabilities of age restricted communities.  I would like to take this opportunity to invite you to be our guest speaker so you can tell us all about the many benefits there are to age restricted communities.  Please let me know when you can do this so we can set a date. <br />

You are quite correct when you say there are no laws that would allow SCCA to return to the original adult only age 18+ status when Sun City was first developed.  The Unruh Act erased that.  However, there is nothing stopping Sun City from removing the 55+ restriction and start to restore property values so members could enjoy some equity.<br />

			<description><![CDATA[This evenings meeting of the Menifee City Council-elect was held at Paloma Valley High School theatre.  The acoustics and sound were great, as was the seating.  Attorneys and law firms vying for the position of interim City Attorney were there early to be interviewed in closed session, as there were in fact two agendas for this evening.  One meeting starting at 5pm and then a 2nd special meeting at 7pm that was open to the public.<br />
<br />
The residents again followed rules of order and signed up in advance to address the council-elect.  Recommendation to form an ad-hoc committee to pre-screen applicants for the City Manager position was presented by Jason Reeves, who was himself a candidate in the recent City Council race.  Rob O'Donnel representing the Valley Health System group offered the facilities of their education center for events and future meetings.  Mayor-elect Edgerton mentioned that Mt San Jacinto college had also graciously offered to host any meetings or events if the city had any need of their facilities.<br />
<br />
A few familiar faces, Barbara Spencer, an attorney who had brought up the Brown Act at last weeks meeting, offered no apology to the council, and in fact asked if any of the attorneys being interviewed had signed a non-conflict of interest clause, and if not, why wasn't that part of the public hearing policy?  Anne Pica, a member of the Menifee School Board had just one question regarding the chamber of council members elected to the City Council and when could we expect their resignation.<br />
<br />
If the City Council-elect learned anything from last weeks public interest in the affairs of the city, it was apparant only in their lack of response to the public commentaries.  That may be more efficient in running a council meeting but it did have the same impact as "falling on deaf ears."<br />
<br />
The comments of the attendees after the council-elect moved to recess and then back into closed session didn't seem to inspire a lot of confidence.  "If they want to follow Robert's Rules of Order then they should be consistent, not just when it's convenient to not respond, how rude" thought Mrs. Nick Zar.<br />
<br />
Mayor Edgerton assured Louis Mazei that there might be a lot of calls on his offer of assistance, while Jason Reeves request for consideration to form an ad-hoc committee to pre-screen applicants was met with no more than a thank you.  I was waiting for the typical, "we'll take it under advisement".  Mayor Edgerton did say again there would be plenty of opportunity for the community to participate in both standing and ad-hoc committees, and it's possible that once they have a city attorney on board they all might be able to take a breath and relax.<br />
<br />
No matter what the communities opinion, there was no lack of interest.  The meeting was well attended.<br />

Most in attendance were there to listen and learn or volunteer for committees.  Bill Zeidlik had sent out a press release requesting a meeting of Cedco members, council candidates who had not been elected and residents with an interest in Community Development, Economic Development and the transition from county to city services.<br />

Joe Daughtery, Don Lundy and Darcy Castillijos were very vocal that Cedco was officially in hiatus and urged Bill to give the council-elect a chance to hire their staff and get to the business of running a city before offering suggestions or advice on how to go about it.  Bill was adamant that the city council had no idea what criteria to use to hire even an interim city manager or attorney, two key positions that are under discussion at this Wednesday's council meeting.  He had hoped that tonight's meeting could help draft a proposal to present to the council-elect so that the council-elect could be briefed on some of the candidates backgrounds as well as local issues that had been on the table at the county level.<br />
<br />
Not much was accomplished, even though several volunteers tried to move the discussion forward without caring about the status or history of Cedco.   Both sides were unwilling to yield however and I felt very much like I'd intruded on a family squabble.  Each side had their own version of the facts based on their past participation with Cedco, the Chamber and cityhood campaigns.  <br />
<br />
It's a shame that there was so much time wasted, but I'm convinced that there were enough people of sound mind in attendance that we won't lack for volunteers and committee members when the time is right.]]></description>

The rest of the country is not on par with the home prices of Southern California and at the national level would have trouble justifying the need to maintain the current loan limits.<br />

Both California Association of Realtors and the National Association of Realtors strongly support legislation that will make permanent the loan limits included in the economic stimulus legislation.  Mortgage availability and affordability continue to be problems, and making the loan limits permanent will create stability in those markets and in our economy as a whole.  The current loan limits, set as part of the Economic Stimulus Package signed into law earlier this year, are set to expire on December 31st. As of January 1st, those loan limits revert to the substantially lower limits in place last year.<br />
<br />
Dramatically reducing these limits on December 31, 2008 would throw mortgage markets into turmoil.  Many real estate markets throughout California are just now beginning to stabilize.  As we head into the summer months, interest rates for the new jumbo conforming loans are equal to or just above traditional conforming loans.  Many REALTORS® are optimistic that affordable conforming and FHA loan financing will become progressively more available. Permanently increasing the FHA and conforming loan limits is the first of many steps Congress needs to take in order to stabilize the housing market and the economy.<br />

    * The economic stimulus loan limits for FHA and the GSEs are equal to 125% of the area median home price, as compared to the previous limits of 100% of the national median for GSEs and 95% of the local area median for FHA.<br />
    * For FHA, limits went up nationwide – with the bottom limit rising from &#36;200,160 to &#36;271,050 and the cap in high cost areas rising from &#36;362,790 to &#36;729,750.<br />
    * For GSE limits, 26 states and the District of Columbia today have communities with limits over &#36;417,000 (the regular GSE limit) -- more than 240 communities in total.<br />
    * According to NAR estimates, permanent limits would enable more than 500,000 borrowers with loans above &#36;417,000 to refinance to lower interest rates. <br />
    * NAR estimates that a permanent increase in the loan limits could mean as many as 350,000 additional home sales, lower inventories, and a 2 to 3 percent increase in home prices next year.<br />
    * NAR also estimates that a boost in home prices could reduce the number of foreclosures by as many as 210,000 by making it easier for consumers to refinance or sell.<br />

			<description><![CDATA[The Menifee council-elect gathered at 5 p.m. at the Kay Ceniceros Center along Newport Road and Evans, to start laying the city's foundation.  There was only one item on the agenda, a closed session on personnel matters.  According to the North County Times article last week, the council-elect's goal was "a closed session on personnel matters",or "a discussion on how to hire personnel who will help make the transition from county to city rule", in another NCTimes quote.  <br />

Just to give you the feeling of having been there, the first order of business was a call to order and then an invocation and the pledge of allegiance.  The roll call of city council-elect members included Wallace Edgerton, Darcy Kuenzi, Frederick Twyman, Scott Mann and John Denver.<br />

There wasn't a lot of discussion prior to the election of officers amongst the council, but the results were as follows:<br />

During the time to "address the City Council on any matter not on this Agenda" the council and the public did just that.  Mayor-elect Edgerton asked the public if there was anyone in the room that represented a committee, government or organization that should be officially recognized.  Quail Valley MAC, Sheriff's Department, Supervisor Stone's office, Darryl Issa's office, Menifee Valley Incorporation Committee, League of Calif Cities, and Romoland School District representatives all introduced themselves and congratulated the council on Cityhood.  Mayor-elect Edgerton then welcomed speakers who had registered in advance to speak.<br />
<br />
The first up was Barbara Spencer, of the Menifee Valley Historical Association, who's carriage and demeanor are an image of protocol and correctness.  She walked up with what looked like a code book in hand and cited a section of the Brown Act, which is the act that dictates public access to public proceedings.  She went on to say that although there are times when it's in the best interest of the city that a council meet in closed chambers regarding salaries, terms, interviewing and the hiring of personnel, she requested the council re-consider tonights CLOSED SESSION deliberations of proposals to be presented by consultants and attorneys.  She thought it would be in the publics best interest to witness the council deliberations and proposals being presented by prospective legal counsel and consultants.<br />
<br />
Bill Ziedlik, of the Menifee Antelope Rural Association, wasn't able to address all of the points he tried to make due to time constraints, but complained of the lack of sufficient public notice for the meeting as well as the agenda of personnel and/or consultants being considered today, the lack of written criteria or RFP notices prior to the planned interviews, the distinction of town or city and how to create future districts.  He mentioned several candidates who hadn't heard of the meeting and did not feel that newspaper articles were an appropriate posting.<br />

When Dave Williams of the League of Calif Cities introduced himself and welcomed Menifee as the 480th city in California, he was asked by Mayor-elect Edgerton regarding the Brown Act and if he and his organization would be available to advise the council on what Barbara Spencer had brought up.  After some discussion, Mayor-elect Edgerton moved to hear the proposals from those expecting private interviews, in public session.  The space, however had been previously booked and so the meeting recessed and moved to new venue in the building.<br />
<br />
To cut to the chase, the new room and facilities were not large enough to be considered "public accessible" for the open session and after some debate amongst council members, some contrarry advice from city attorneys who were there to present a proposal to the council, it was moved to adjourn and a the next meeting would be set for Wednesday at 7pm.  The location is still to be determined, and don't be surprised if the meeting time changes as well.  Stay tuned for further updates.  Needless to say, the closed session did not happen.<br />

I was very proud of how the council-elect conducted themselves, not in rules of order, for there are plenty of people around to remind them of that, but in the wisdom they showed to respond to the attendees of the first city council meeting.  The other candidates who were not elected, kept their promise too, and were there in force to assist and contribute and congratulate.  Chris Thomas added that it was in the council's best interest to conduct as much business as possible in open sessions and cited our neighbor city's who did not heed to that wisdom.  As a resident and scribe I believe that wisdom and prudence prevailed tonight.  Residents and the public were able to watch their new government in action and when our council men cared more for what they owed the public in open session than what may have been promised to consultants who had expected to be heard, I grew a little more proud.]]></description>

The scheduling change would be made for the 2009 - 2010 school year.  A lot of work must be done to initiate the change and the issue is still open for discussion at the next June 24th board meeting.<br />

I love the prospect of it.  Our summers are too hot to warrant normal school activities.  I've also never believed that it was in the students best interest academically or socially to work through their year round tracts.  Seems they spent more time in review then in depth studies.  Even promotion ceremonies are split by tract.  I couldn't be happier.]]></description>
